Terms of service
These terms cover the splitshare.tech website only. There is nothing to buy here, no account to open, and no money moves through this domain. The terms governing the SplitStock product are separate.
Acceptance of terms
These Terms of Service govern your use of splitshare.tech, operated by Splitshare Technologies Private Limited("Splitshare", "we", "us"). By using this website you agree to be bound by them.
What this website is
splitshare.tech is a corporate information website. It describes the company, its registration details and its product. That is all it does.
Nothing on this website is an investment product, a brokerage service, an account, or an offer to sell securities. There is no form on it, so it does not collect personal information from you unless you email us directly.
In plain terms
You cannot buy anything here, and nothing you do here creates a financial relationship with us. Everything transactional happens on SplitStock, under its own terms.
Eligibility
There is no age restriction on reading a company information page. If you contact us, you confirm that you are at least 18 and that what you tell us is accurate.
Eligibility to use the SplitStock product itself, which does have requirements including age, residency and PAN, is governed by the SplitStock terms.
No investment advice or solicitation
Everything on this website, including anything describing SplitStock, fractional ownership or cross border investing, is general and educational. It is not investment advice and it is not a recommendation to buy or sell any security. Take advice from a qualified adviser before making an investment decision.
Risk disclosures
Investments in securities are subject to market risk. The value of an investment can fall as well as rise and principal may be lost. Past performance does not guarantee future results.
Where an investment is denominated in a foreign currency, movements in the rupee to dollar rate affect the rupee value of the holding independently of how the underlying asset performs. A gain in dollars can still be a loss in rupees.
The full position is set out in the SplitStock risk disclosure.
Reference: standard SEBI and FINRA risk disclosure practice.
Regulatory status
SplitStock is pre-launch. It intends to operate as a technology platform facilitating cross border fractional share investing for investors in India under the Liberalised Remittance Scheme framework established by the Reserve Bank of India.
The required regulatory and brokerage partnerships are still being established. Splitshare Technologies Private Limited is not currently a registered broker, a registered investment adviser, or a bank. Using this website does not create a brokerage relationship.
Cross border notice
Cross border transactions, once SplitStock is operating, are governed by the Liberalised Remittance Scheme. Investors are responsible for their own compliance with applicable FEMA requirements, including the annual remittance limit in force, and for the tax reporting their foreign holdings generate.
Reference: Foreign Exchange Management Act, 1999, and the RBI Master Direction on the Liberalised Remittance Scheme.
Intellectual property
The Splitshare and SplitStock names, the company mark, and all content on this website are the property of Splitshare Technologies Private Limited and may not be copied, reused or distributed without our permission.
Third party links
This website links to splitstock.in and may link to other third party websites, including public registries where our registration details can be verified. We are not responsible for the content, terms or privacy practices of a site once you leave splitshare.tech.
Disclaimers and limitation of liability
This website is provided as is, without warranties of any kind. To the fullest extent permitted by law, Splitshare Technologies Private Limited will not be liable for indirect, incidental or consequential loss arising from your use of it.
Nothing in this clause excludes liability that cannot be excluded under Indian law, liability arising from our gross negligence or wilful misconduct, or liability whose exclusion is prohibited under the Consumer Protection Act, 2019.
Relationship to the SplitStock terms
These terms govern the splitshare.tech website only. If you go on to use SplitStock, that use is governed by its own terms of service at splitstock.in/terms, which cover the things this website has none of: accounts, identity verification, fees, order execution and settlement.
Governing law and disputes
These terms are governed by the laws of India. Any dispute arising out of or relating to them is subject to the non-exclusive jurisdiction of the courts at Gautam Buddha Nagar, Uttar Pradesh.
Why non-exclusive
Non-exclusive is deliberate. An exclusive clause would require you to travel to our home district to bring a claim, and the Consumer Protection Act, 2019 gives a consumer the right to file where they live. We are not going to use our own terms to take that away.
Reference: Consumer Protection Act, 2019.
Changes to these terms
We may update these terms as the company and its regulatory position change. The updated version is posted here with a new effective date, and where a change is material we will make reasonable efforts to say so.
